What are the wage and hour requirements for minors working on a farm?
Wages, hours worked, and course credit
When a law goes into effect adjusting wages, how long does it remain until it is addressed/altered again?
Under the law, the “effective minimum wage rate” for any given year is the highest of the federal minimum wage rate, the minimum wage rate set by New Jersey statute, or a minimum wage rate adjusted to account for increases in the Consumer Price Index (CPI). Since New Jersey minimum wage is higher than the federal minimum wage rate, it is in effect in the state. Minimum wage increases occur on the first day of the year. Please visit mw-220.pdf (nj.gov) for projected minimum wage increases.
If an individual has a standard teaching certificate and has taught in the past, but is currently in non-teaching positions at a school district, can that person still be appointed to be the SLE teacher?
Children must be at least 12 years old to work on a farm. There are certain jobs a 12-year-old can do under federal and state law. Minors under 16 cannot work during the hours which they are required to be in school and they cannot work outside of school hours more than 10 hours in any day, more than 40 hours in a week and not more than 6 days in a row. Minors under 18 in agricultural work are not covered by the New Jersey Minimum Wage but may be covered by the Federal Wage and Hour rates. Minors can also take part in an unpaid internship on farms.
12-13 years old: can be employed outside of school hours. First 90 consecutive days, paid $4.25/hr, otherwise statutory minimum wage/hr
14-15 years old: can do any agriculture occupations outside of school hours without parental consent, except those identified as “hazardous”
16 and up: considered an adult in the eyes of the law regarding hazardous agricultural occupations
18 and up: can work overtime, but paid minimum wage/hr
